About the Lecture
This lecture will explore ‘negotiating damages’ as a remedy for breach of contract or other wrongs in light of the decision of the Supreme Court of the United Kingdom in Morris-Garner v One Step (Support) Ltd [2018] UKSC 20. Both the availability and nature of such awards have long been a source of disagreement and One Step represented the first opportunity for the United Kingdom’s ultimate appellate court to contribute to these debates. The Court held that ‘negotiating damages’ are best understood as awards of compensation for loss rather than being gain-based; and that they are available only in substitution for an injunction (or specific performance) or for interference with proprietary rights and closely analogous rights.

About the Speaker
Andrew Burrows, MA, BCL, LLM (Harvard), QC (Hon), FBA, DCL, Barrister and Honorary Bencher of Middle Temple, is Professor of the Law of England and a Fellow at All Souls College, University of Oxford.

In June 2020, Professor Burrows will take up his appointment as a Justice of the Supreme Court of the United Kingdom, after a long, influential and most distinguished career in academia and law reform.

Amongst many other appointments, he was a Law Commissioner for England and Wales (1994-1999) and President of the Society of Legal Scholars (2015-16).

Professor Burrows has written extensively on the law of obligations and remedies, particularly on remedies, defences and other issues in contract, tort and restitution, on statutory interpretation, on the judicial function, and on the continuing interaction of statute and common law.
