DESCRIPTION:2024 SCIL International Law Year in Review Conference\nIn-person event \nThe annual SCIL Year in Review conference will host a number of exciting panels covering major developments in international law in 2023. \nOur keynote is the newly-appointed United Nations Special Rapporteur on the Promotion and Protection of Human Rights and Fundamental Freedoms while Countering Terrorism\, Professor Ben Saul\, who will discuss the appointment and the major issues arising in relation to the position. \nThe conference will include a literary lunch featuring James Bradley (author of Ghost Species\, Clade\, and the upcoming Deep Water) in conversation with Michaela Kalowski (interviewer and curator). \nIn addition to the regular panel on international law cases in Australian courts\, and Australia’s role in international court cases\, we will have special sessions on: \n\nthe Law of the Sea in 2023 – including presentations on the ITLOS Advisory Opinion on Climate Change\, and new developments on seabed mining and offshore renewable energy\nPrivate International Law in 2023\, including presentations on the London Steamship v Kingdom of Spain case\nInternational law and developments in technology in 2023.\n\nView the program here. \n———————- \nFriday 23 February 2024\nVenue: New Law Building (F10)\, University of Sydney (Camperdown Campus)\nRoom to be confirmed\n  \nRegistration \n\nFull-fee: $100\nNon-USYD student/concession: $50\n\n———————- \nAbout the literary lunch \nJames Bradley is a writer and critic. His books include the novels Wrack\, The Deep Field\, The Resurrectionist\, Clade and Ghost Species\, a book of poetry\, Paper Nautilus\, and The Penguin Book of the Ocean. His essays and articles have appeared in The Monthly\, The Guardian\, Sydney Review of Books\, Griffith Review\, Meanjin\, the Weekend Australian and the Sydney Morning Herald. In 2012 he won the Pascall Prize for Australia’s Critic of the Year\, and he has been shortlisted twice for the Bragg Prize for Science Writing and nominated for a Walkley Award. He lives in Sydney. His new book Deep Water\, out on April 3\, explores how the ocean has shaped and sustained life on Earth from the beginning of time. Weaving together science\, history and personal experience\, it offers vital new ways of understanding not just humanity’s relationship with the planet\, but our past – and perhaps most importantly\, our future. \nMichaela Kalowski is an interviewer\, moderator & curator for writers and ideas festivals. Highlight interviews include Margaret Atwood\, David Mitchell\, Michelle de Kretser\, & Stan Grant. She’s the curator of Big Weekend of Books\, ABC RN’s on-air writers’ festival that takes place in mid June and is now in its fifth year. \nShe also produces and hosts a monthly books conversation event for Petersham Bowling Club called Readers. Michaela has conducted radio interviews and presented programs across ABC radio and is currently a co-host of The Bookshelf. She’s co-presenter & co-writer of a two-part podcast for ABC RN\, tracing part of her family’s history\, called Laya’s Way Home. \n  \nThis event is hosted by the Sydney Centre for International Law at The University of Sydney Law School.

This informal panel brings together experts and practitioners in sports law and governance from Japan and Australia\, two countries at the forefront of development of global sports law\, to discuss the big legal issues currently shaping the sports landscape. The panel examines the governance of sporting organisations and the regulation of labour mobility in the context of a globalised sports world. \nThe panel will feature presentations from: \n\nProfessor Deborah Healey (University of New South Wales) on “Corporate Governance in Australian Sport”;\n\nProfessor Healey is the Director of the Herbert Smith Freehills China International Business and Economic Law (CIBEL) Centre and the Editor of the Sports Law Journal. She has more than 30 years of experience serving on the boards of major sports governance organizations. \n\nMr. Shoichi Sugiyama\, (Partner\, Field-R Law Offices\, Tokyo) on “The Transfer System in Nippon Professional Baseball”;\n\nMr. Sugiyama counsels the Japan Professional Baseball Players Association and the Japan Sports Arbitration Agency (the independent dispute resolution body for sport-related disputes in Japan). DESCRIPTION:Underutilisation of ADR in ISDS: Resolving Treaty Interpretation Issues\nOnline event \nOver the years\, it has become evident that arbitration is the favoured dispute resolution mechanism over conciliation/mediation in investor-state dispute settlement (ISDS). This is due to the benefits of arbitration (binding process with final\, enforceable award) over the shortcomings of conciliation/mediation (non-binding process with non-enforceable settlement agreements). Therefore\, incentives\, such as the recent adoption of the Singapore Convention on Mediation and proposed amendments by ICSID\, are deemed promising developments for the promotion of more alternative dispute resolution (ADR) mechanisms in ISDS. \nThis study advances a hypothesis that\, apart from the non-enforceability of settlement agreements\, there may be an additional and\, as a matter of fact\, the principal cause for the underutilisation of conciliation in ISDS. The common formulation of ISDS clauses\, that carry advance consent to conciliation and arbitration in investment treaties\, suggests that the choice between these two may have conflicting interpretations. Under one interpretation\, disputants have an option to choose conciliation and then proceed with arbitration; the other interpretation suggests that selection of conciliation is to the exclusion of arbitration. This is also supported by anecdotal evidence where claimants have had an impression that the ‘fork in the road’ principle applied to the choice between conciliation and arbitration\, and that\, therefore\, recourse to conciliation regardless of the outcome would jeopardise their right to subsequent arbitration. Based on these observations this study argues that the adoption of the Singapore Convention on Mediation will most probably not be enough to promote more ADR in ISDS. In particular\, recourse to investor-state conciliation (and mediation) will not increase unless mediation/conciliation are made mandatory before arbitration\, and the source of conflicting interpretations of the choice between conciliation and arbitration is eliminated. \nUbilava\, A.
