Digital trade and digital sovereignty: Navigating best practice for cross border data transfers

This talk aims to explore the challenges of privacy and security protection when Australian companies outsource personal and commercial data from Australia to technology service providers in India, China and other countries.

The traditional jurisdiction rule is based upon geographical domains that divide each country, but cross-border digital transactions are often claimed to be “de-territorialized”. There is a lively public debate in Australia about how to regulate these transactions and ensure Australian consumer rights will not be compromised. Based on a comparative-law approach, this talk aims to map the challenges and discuss tentative solutions.

– David Markus, Vice President, Head of Privacy Asia Pacific, State Street Corporation

David Markus is the Head of Privacy for Asia Pacific at State Street. David advises all business units on privacy, data security, privacy by design, breach management and new technologies. David has over 12 years of legal and compliance experience in the public and private sector including as a consultant for the United Nations. David is on the editorial panel of the Lexis Nexis Privacy Law Bulletin.
