Beyond the Pandemic: New Frontiers in Asia-Pacific International Dispute Resolution
What are the current and potential repercussions of the COVID-19 pandemic, for international dispute resolution especially in the Asia-Pacific region?
- What are the impacts on regional supply chains and FDI?
- Will foreign investors really be able to bring many ISDS claims under investment treaties against host states for implementing public health counter-measures?
- Will that possibility and other developments around ISDS lead to more innovations such as host states being allowed to require mediation attempts before arbitration, as under the new Indonesia-Australia FTA?
- Will Asia-Pacific FTAs be (re-)drafted to bolster dispute resolution mechanisms and hence credible enforcement not only for referenced environmental protection treaties (as already in the CPTPP), but also for WHO measures so as to improve public health co-ordination and outcomes?
- How will the dramatic shift to virtual hearings in international investment and commercial arbitrations, and even in some courts, impact on the attractiveness of Australia, Hong Kong and China as seats for arbitration?
A panel of experts will briefly discuss each of these issues in roundtable format, drawing mainly on their co-edited book in press with Kluwer, “New Frontiers in Asia-Pacific International Arbitration and Dispute Resolution“.
